Terms of Service

1. Acceptance

By joining Baniya Network of India ("the Platform"), you agree to these Terms. If you disagree, please do not use the Platform. These Terms are governed by the laws of India, including the IT Act 2000, IT Rules 2021, and DPDP Act 2023.

2. Eligibility

• You must be at least 18 years of age
• You must be a member or associate of a Hindu Vaishya business community
• You must provide accurate identity and business information
• One account per person — multiple accounts are not permitted

3. Member Conduct

As a member, you agree to:

• Conduct yourself with honesty, respect, and community spirit
• Not post false, misleading, or fraudulent business information
• Not harass, defame, or discriminate against other members
• Not use the Platform to spam, solicit, or run scams
• Not attempt to access other members' accounts or data
• Honour referral commitments and barter agreements in good faith

Violations may result in immediate account suspension or termination.

4. Business Directory

Your name, business name, city, and community are displayed in the public directory by default. You may request to hide your listing by contacting us. We do not verify business claims — members deal at their own discretion.

5. Referrals & Barter

The Platform facilitates introductions and barter matches. Baniya Network is not a party to any referral deal or barter transaction. We do not guarantee outcomes, payments, or delivery of services. All transactions are directly between members.

6. Shark Tank

Shark Tank pitch submissions are reviewed by our community. Submission does not constitute an investment offer. Investment decisions are entirely between pitching members and interested investors. The Platform takes no commission or liability for investment outcomes.

7. Plans & Payments

• Free plan: Directory listing, referrals, basic community access
• Premium (₹999/month): Priority listings, barter facilitation, Shark Tank access
• Corporate: Custom pricing — contact us

Payments are processed securely. Refunds for premium plans are available within 7 days of payment if no premium features were used.

8. Content

You retain ownership of content you submit. By submitting, you grant us a non-exclusive licence to display it on the Platform. We may remove content that violates these Terms or applicable law without notice.

9. AI-Generated Content

The Platform uses AI tools to generate community briefings, content drafts, and match suggestions. These are for guidance only. We do not guarantee accuracy of AI-generated content. Do not rely on AI briefings for financial, legal, or medical decisions.

10. Grievance Redressal (IT Rules 2021)

We appoint a Grievance Officer as required by Rule 3(2) of the IT (Intermediary Guidelines) Rules 2021:

11. Limitation of Liability

The Platform is provided "as is." To the maximum extent permitted by Indian law, we are not liable for any indirect, incidental, or consequential damages arising from use of the Platform, including losses from business dealings between members.

12. Termination

We may suspend or terminate your account for violations of these Terms, fraud, or inactivity (12+ months). You may delete your account at any time by contacting us — your data will be purged within 30 days.

13. Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in New Delhi, India.
